5053.08 | Schools are to be Free of Weapons

  1. After immediate suspension, pursuant to Idaho Code 33-205, and in conformity with the federal Gun Free Schools Act, the Board shall expel from school for a period of not less than one (1) year (twelve calendar months) a student who has been found to have carried a weapon or firearm on school property. In accordance with Idaho Code 18-3302D and 33-205, the Board of Trustees may modify the expulsion requirement on a case by case basis. The Board of Trustees, at its discretion, may designate the Superintendent to modify the expulsion requirement on a case by case base, in accordance with the federal Gun Free Schools Act. Discipline of students with disabilities shall be in compliance with federal and state statutes and related regulations pertaining to students having disabilities. The Superintendent shall report such student and incident to the appropriate law enforcement agency.
  2. District employees shall have the right to search all students or minors, their belongings and lockers, which are reasonably believed to be in violation of this policy.
  3. The District will not admit, or continue to enroll, a student who has been expelled from another district for violating applicable federal or state law pertaining to the carrying of a weapon or firearm on school property until the student has completed the expulsion period of not less than one calendar year. The timing of the period of expulsion will be based on written confirmation from the district that initially expelled the student. A student who wishes to challenge a decision made by the Trustees that denies admission to a student from another district, who has been expelled by that district under this policy, is entitled to a hearing in executive session before the Trustees.   4. This policy does not apply to persons in private vehicles delivering children to and from school or school activities, nor when a person is carrying a firearm as part of the requirements of a hunter safety course offered by or approved by the District, or if a person is carrying a firearm pursuant to a requirement of law or in compliance with law.
